PREAMBULE
The below General Terms and Conditions of Sale (hereafter called “GTCS”) are exclusively entered into by (1) the MAISON LEJABY company, registered with the trade and companies register (RCS) 539522 607 00065 under the number 539 522 607 and having its registered office at 392 rue des Mercières, 69140 Rillieux La Pape, as publisher of the website maisonlejaby.com, exclusive owner of the online operating licence of the brand MAISON LEJABY and (2) any person making a purchase on the website maisonlejaby.com (hereafter called the “Customer”).
The Customer hereby declares that he/she is a private individual, not a professional or trader, that he/she is of age or has parental authorisation and that he/she has full legal capacity to contract and place an online order on the website maisonlejaby.com.
The Customer and MAISON LEJABY both agree that their relations will be exclusively governed by these General Terms and Conditions of Sale. To this extent, the Customer acknowledges that any order validated by “double click” implies the irrevocable adhesion to these General Terms and Conditions of Sale. This validation by the Customer associated with the authentication process and non-repudiation and with the protection of the integrity of messages constitutes the unequivocal expression of intention of Parties deemed signatories of the distance sales contract.
MAISON LEJABY reserves the right to adapt or modify at any time these General Terms and Conditions of Sale. Every order will be deemed to be conducted according to the GTCS in force on the day it is placed on the maisonlejaby.com website, the date the GTCS are put online will be the date they are in effect.

ARTICLE 1. VALIDATION OF THE ORDER ON THE maisonlejaby.com WEBSITE
To place an order on the website maisonlejaby.com, the Customer will see the following steps:
- Choice of products on the site in the “Basket”,
- Choice, when it is offered, of the delivery method for the products shown in the “basket”,
- Presentation of order summary, modifiable, and its total price,
- Choice of payment method,
- Delivery of a confirmation email to the Customer confirming the order has been placed after his/her payment has been accepted.
The order validation email sent to the Customer confirms MAISON LEJABY has accepted the Customer’s order, and confirms the creation of a sales contract between the Parties.
ARTICLE 2: VALIDITY OF OFFERS – AVAILIBILITY OF PRODUCTS
The products shown on the maisonlejaby.com website at a given time are in principle deemed in stock at that time, except for time-limited offers that are part of a specific deal expressly stated as such on the product page.
This assumed availability is verified after the payment for the order has been accepted and is confirmed by the sending of a shipping email by MAISON LEJABY.
In the case that one or more products is unavailable, MAISON LEJABY agrees to either offer the Customer a new delivery date for the product or products ordered, or to refund them by recrediting the payment method used for the order within 14 calendar days of paying for the order. If a technical issue prevents a refund to the payment method used, MAISON LEJABY will offer to issue the Customer a cheque and to send it to him/her by post to the saved billing address.
Offers on products and prices are deemed to be those shown at the time of payment represented by the “BASKET” page on the maisonlejaby.com website. Thus, only the price shown on this page, corresponding to that billed to the Customer when ordering, is authoritative and commits MAISON LEJABY contractually. Beyond this, MAISON LEJABY shall not be held responsible for any typographical error on any other page likely to occur in design and/or promotional elements throughout the site.
ARTICLE 3: PRICE
Prices shown on the uk.maisonlejaby.com website are given in Pound (£) and in public prices inclusive of all charges as they are applicable in metropolitan France at the time of visiting said offers. The VAT charged is the rate in effect at the time of the order being placed. Specific taxes, beyond VAT, applicable in accordance with regulations (such as the eco-tax on furniture or the eco-fee), are only shown on the basket page, the only authoritative page as stated in the last paragraph in Article 2 above.
All the product prices shown on the maisonlejaby.com website do not include delivery costs or any other additional services. They only include the price of the product itself, as it is described as well as its packaging.
MAISON LEJABY reserves the right to change its prices at any time but agrees to apply the prices displayed at the time the order is placed, subject to availability at that date.
Products remain the property of MAISON LEJABY until complete payment has been made to the company.
ARTICLE 4: PAYMENT
4.1 PAYMENT METHODS
Whatever the payment method chosen from among those accepted on our site, orders will not be deemed to have been placed until validation or receipt of payment.
Thus, until the payment has been validated by the intermediary chosen by the consumer, the order will not prepared by MAISON LEJABY.
4.1.1 Upfront payment by bank card
Payment can be made by the following bank cards: debit card, VISA, MASTERCARD and MAESTRO.
The Customer is able to consult the General Terms and Conditions of Sale and Use of each of these bank cards on the site of our partners.
The choice of one of these payment cards counts as tacit acceptance of the general terms and conditions of sale and use of the aforementioned partners.
We invite our customers to refer these terms and conditions, as MAISON LEJABY cannot accept responsibility for the conditions imposed by these independent partners.
Online payment by bank card is perfectly secure and allows you to enter with complete confidence the number, expiration date and security code of the card in the relevant spaces. The credit card details are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment is directly made through the bank. MAISON LEJABY never has access to these details and cannot save them on its servers. That is the reason these details are requested during every new transaction on our site.
4.1.2 Upfront payment by Paypal
Paypal payments are accepted on the MAISON LEJABY site and are made by the intermediary of the partner in question and according to their own general terms and conditions of sale and service usage.
We invite our customers to refer these terms and conditions, as MAISON LEJABY cannot accept responsibility for the conditions imposed by these independent partners.

4.2 COMBATTING FRAUD
MAISON LEJABY reserves the right to verify the validity of the payment, before the order is shipped, by all methods it deems necessary (particularly identity documents, proof of address, etc.).
4.3 PAYMENT ISSUES
MAISON LEJABY reserves the right to refuse to deliver or honour an order from a Customer who has not fully or partially paid for a previous order or with whom a payment dispute is still ongoing. In the case of fraud, MAISON LEJABY reserves the right to cancel any membership without any warning or damages.
ARTICLE 5 : DELIVERY
5.1 ORDER PREPARATION TIMELINES
MAISON LEJABY reserves the right to subcontract all or part of the preparation and delivery of the order to a third-party engaged to carry out this service.
All products sold by MAISON LEJABY being deemed available, orders are prepared in under 48 working hours starting from the first working day following the order being accepted within the meaning of these GTCS. Thus, orders accepted on Saturdays, Sundays or a public holiday will be dealt with on the next working day.
All timelines mentioned on the maisonlejaby.com website are understood as clear time limits.
Products ordered are delivered to the address on the order form and saved as the “delivery” address.
In the case of data-input errors, particularly incorrect or incomplete delivery addresses, MAISON LEJABY shall not be held responsible for the consequences in terms of delays to deliveries or deliveries not being possible. All costs related to redelivery of products following a data-input error by the Customer will be assumed by the Customer alone.
5.2 ORDER SHIPMENT TIMELINES
MAISON LEJABY reserves the right to choose the most appropriate delivery method according to the nature of the product, of its weight and size, which the Customer declares to have acknowledged and accepted.
Delivery times may not exceed 30 working days after the date of payment validation by the Customer (date of the order being placed).
Delivery times cannot be guaranteed in the case of force majeure, as defined by the law and case law. Delivery times do not take account of possible Customer payment verification processes that may delay the shipping of his/her order (see the provisions of article 4.2). Stated timelines start from the placement of the order. The estimated delivery date is given when ordering and on each of our product descriptions. This timeline is an average for the service used for delivery in mainland France. In the case of absence, the Customer will be responsible for collecting the product from the relevant services.
5.3 DELIVERY TRACKING
The Customer can at any moment follow his/her order using the order number that is shared with him/her in the email formally accepting his/her order, in the “My Account” area of the maisonlejaby.com website.
This area enables accurate monitoring of each planned mode of transport, of the order and its status, particularly related to shipping or delivery.
It is recalled that as all communication between the Customer and the maisonlejaby.com website mainly takes place on email, it is essential that the Customer provide MAISON LEJABY with a valid and regularly updated email address. In the absence of this, MAISON LEJABY shall not be held responsible for the consequences resulting from communication with an incorrect or not updated email address.

ARTICLE 6: RIGHT OF WITHDRAWAL
6.1. CONDITIONS FOR EXERCISING THE RIGHT OF WITHDRAWAL
⇒ Timelines
In accordance with Articles L. 121-21 of the French Consumer Code, the Customer has 14 calendar days to exercise his/her right of withdrawal, without needing to give any justification. This period starts from the day after receipt of the order.
In the case of an order where several goods are delivered separately or in the case of a good made up of several parts or pieces for which delivery is staggered over a set period, this period starts from receipt of the last good or part or piece. For contracts that provide for the regular delivery of goods over a set period, this period starts from receipt of the first good.
⇒ Exercising the right of withdrawal
To exercise his/her right of withdrawal, the Customer must inform MAISON LEJABY of his/her decision by sending, before the end of the aforementioned 14-day period, the template withdrawal form provided for this purpose, which will have been sent to the Customer with the email confirming his/her order (and reproduced in the annexe of these GTCS), or any other clearly worded declaration expressing his/her wish to withdraw.
⇒ Loss of right of withdrawal
In accordance with Article L 121-21-8 of the French Consumer Code, it is recalled that the right of withdrawal can not be used for contracts for:
1. The provision of services fully performed before the end of the withdrawal period and where performance has begun after the consumer’s express consent and renouncement of his/her right of withdrawal;
2. Provision of goods or services whose price depends on fluctuations in the financial market which are outside the control of the trader and which are likely to occur during the withdrawal period;
3. The provision of goods made to the specifications of the consumer or clearly personalised;
4. The provision of goods likely to deteriorate or expire rapidly;
5. The provision of goods which have been unsealed by the consumer after delivery and which cannot be resent for hygiene or health protection reasons;
6. The provision of goods which, after delivery and because of their nature, are inseparably mixed with other items;
7. The provision of alcoholic drinks whose delivery is deferred beyond thirty days and whose value agreed on conclusion of the contract depends on market fluctuations outside of the control of the trader;
8. Maintenance or repair works urgently carried out in the home of the consumer and expressly requested by him/her, limited to replacement parts and works strictly necessary to respond to the emergency;
9. The provision of audio or video recordings or of computer software when they have been unsealed by the consumer after delivery;
10. The provision of a journal, newspaper or magazine, except for subscription contracts to these publications;
11. Concluded at a public auction;
12. The provision of accommodation services, other than residential accommodation, transportation of goods, vehicle hire, catering or leisure activities that must be provided at a specific date or period;
13. The provision of digital content which is not provided on hardware support where performance began after the consumers’ express prior consent and express withdrawal of his/her right to withdrawal.
⇒ Condition regarding the state of the product
To exercise this right of withdrawal, the product must be returned in a state allowing it to be immediately resold. The product therefore must be returned as new, with all manuals and accessories it was delivered with and in its original packaging. MAISON LEJABY reserves the right to refuse to refund the product if all these conditions are not met.
⇒ Refund methods
If the right of withdrawal is exercised in the aforementioned period, and in accordance with the provisions of Article L121-21-4 of the French Consumer Code, MAISON LEJABY will refund the Customer the price of the product or products returned within 14 calendar days starting from the date it was informed of the Customer’s decision to withdraw.
MAISON LEJABY nevertheless reserves the right to defer the refund until the goods have been received or until the Customer has provided proof of the shipping of these goods, whichever is the earliest.
The refund will always be made based on the prices actually paid by the Customer, as written on his/her bill. However, MAISON LEJABY reserves the right to refuse to refund supplementary delivery costs resulting from the Customer expressly choosing a more expensive delivery method when MAISON LEJABY offered him/her a standard delivery method.
The transport costs to be refunded will be determined as if the Customer had never bought the returned product or products.
Finally, on principle and unless expressly requested by the Customer, MAISON LEJABY will refund the Customer by recrediting the payment method used. If materially impossible to use this process, MAISON LEJABY will offer to issue the Customer a cheque for the amount due and to send it to him/her by post.

ARTICLE 7: ORDER COMPLAINTS
If when unpacking his/her products and within the 15 calendar days starting from receipt of the products, the Customer discovers that a product does not match the order or product description (for example, the wrong product, model, colour, etc.) MAISON LEJABY offers to replace the product or to refund the Customer the total cost as soon as the mistake is identified and confirmed.
To do this, the Customer must contact MAISON LEJABY’s Customer Services to make the complaint and follow the stated procedure.
After receiving the returned product and ascertaining the non-conformity or damage reported by the Customer, MAISON LEJABY may, in its sole discretion,
- Either send a new product to the Customer, with no additional cost,
- Or refund the amount paid for this product.
Any other possible default in the course of the “life” of the product will be assessed as part of the after-sales service.
ARTICLE 8: AFTER-SALES SERVICE
Outside of a commercial or legal guarantee, the Customer can always contact MAISON LEJABY’s Customer Services with any questions regarding the use of a product, its upkeep methods or to order a piece that has become defective.
ARTICLE 9: INTELECTUAL PROPERTY
All elements on the maisonlejaby.com website whether visual or sound, including the brand, logo, texts, photos, videos and the domain name, are protected by copyright, trademark law or patents. The publisher of the maisonlejaby.com website is the holder of a licence and exclusive exploitation rights agreement granted by their owner. For this reason and in accordance with the provisions of the intellectual property Code, only private use is authorised, subject to different or more restrictive provisions of the intellectual property code. Any total or partial reproduction of the maisonlejaby.com website or of any of its audio, visual or text content is strictly prohibited without express and prior written consent.
ARTICLE 10: RESPONSIBILITY
For all the stages of access to the site, the ordering process, delivery, Customer service or subsequent services, MAISONLEJABY is only held to a best-efforts obligation. Therefore, MAISON LEJABY cannot be held responsible for any inconvenience or harm inherent in using the Internet, such as a breach in service, external intrusion or the presence of a computer virus, or for any event deemed to fall under force majeure, in accordance with case law.
In addition, MAISON LEJABY shall not be held responsible if an order does not succeed or is prevented from fulfilling any of its obligations by an event of force majeure under case law, and particularly in the case of bad weather preventing the order being delivered.
ARTICLE 11: CHANGES TO THIS CONTRACT
In the event of one of the clauses of this contract being declared null because of a change in legislation, regulation or because of a court ruling, this does not in any way affect the validity and compliance of all the other provision of these General Terms and Conditions of Sale.
ARTICLE 12: DURATION
These GTCS apply for the entire duration of the time the services and products offered by MAISON LEJABY are offered.
ARTICLE 13: PROOF
The computerised records, kept by MAISON LEJABY and its partners in conditions of appropriate security, will be considered as proof of communications, of orders and of payments made between the Parties.
ARTICLE 14: RECORDING AND FILING OF TRANSACTIONS
The archiving of purchase orders and invoices is done in a reliable and durable way in order to provide a true and durable copy in accordance with Article 1348 of the French Civil Code.
ARTICLE 15: DISPUTES
These conditions are subject to French law.
In the event of a dispute, MAISON LEJABY and the Customer will attempt to resolve this out of court, either by a conventional mediation procedure or by any other alternative method of dispute resolution. Should the process fail, only the French courts have jurisdiction.
